We are in the beginnings of a potential hot issue at our department. Guys that have had personal emergencies have always been able to use sick time in the past. Now, they are telling us we need to use either comp time, vacation or holiday time. For instance, a guy had a fire at his house recently and was told he had to use other than sick time. A guy had his furnace go out and was told the same thing. Another guy used sick time for a family emergency, and it was changed on his time card for him. This is new, this has never been an issue in the past. Does anyone have a policy on this or know the legal issues behind whether or not this can be done.

The legal aspect of sick time could be interpreted through the way your department is. Although it's something that has occured in the past, they may be evolving to newer measures. Most departments (and jobs) now require a doctors note for "sick days." Sick notes from a doctor aren't difficult to come by, but it seems to be a standard procedure.

As for the department changing the terminology on anyones time sheet, I would approach your Union reps about it. (if your union) If you aren't union, it's time for clarified language in the rules so everyone is on the same page.
The Union is getting very heavily involved. There has never been any sort of sick time policy on the books. We have no policy in our contract either. There was an incident this year invloving the abuse of sick time, that we fought and won. This is probably in retaliation for that.
and without the specific language in the contract, you will beat this one too. Have faith and push for whats right. I would have everyone thats been affected file a grievance.
I agree, we don't file enough grievances. And by not doing so, we allow them to walk all over us.
I was going to say this sounds like a collective bargaining issue. Although you might win during this contract, my guess is it is going to be changed with your next contract. The powers to be are trying to stop the abuse of sick time.
Hey J, I work in a Correctional facility and I have to agree with 913, if it's not worded specifically in your contract then you can use your sick time any way deemed fit. Are merely states that if you use more than two in a row you need a doctors slip for the third day. Otherwise you probably earn one day a month like most of us and us it when necessary instead of comp, pl, or floaters. You'll do fine if the Union is involved...
Our administrators are sick leave Nazi's. The only saving grace is HIPPA! They can not ask you why you are using it. If they do, take action. This happened here. Now they encourage us not to abuse it.
