BOSTON - A former Boston firefighter who participated in a bodybuilding contest after claiming he was permanently disabled has pleaded not guilty to fraud.
Albert Arroyo pleaded not guilty in federal court in Boston on Thursday to one count of mail fraud for what prosecutors say was an attempt to collect a tax-free accidental disability pension to which he was not entitled.
The 47-year-old Arroyo claimed he was disabled when he hurt his back after he slipped and fell in a Jamaica Plain fire station in March 2008, but was seen two months later participating in a body building contest.
A lawyer representing Arroyo has said that bodybuilding was good for his back injury. But prosecutors say Arroyo didn't disclose the physical activity in his disability pension application.

We once had a work comp claimant claiim that horseback riding was good for their back injury.
We had video of another one that was off work with a back injury taking his warm up swings and then jacking them out of the park during batting practice. Got excellent video of him sliding into second base to break up a double play. He didn't come back to work. His benefits stopped, his attorney settled and he was fired. Lucky he wasn't charged with fraud, but back then, it was unheard of.
It is amazing what people will do.
Morons such as this is what gives those that deserve and NEED the disability benefits problems....Too bad they only charged him with fraud...I would add filing a false statement, grand larceny, perjury, and not only charge him but fire him with total loss of benefits as well.....Gives us all a black eye.......Paul
I wonder if his benefits that he has been receiving will be taxable, because I think he'll have a tax beef to go with the other fraud charges. I see the city, union, their insurance carrier and the IRS lining up to get a piece of this guy.
I have heard of therapeutic horseback riding, I know of one case where it was also beneficial to take the supervisors kids horseback riding while on medical leave.
