Can Sex Offenders be firefighters? Should sex offenders be firefighters? What about pardoned ones?

I am currently working on a story and one of the intriguing details is that a current firefighter WAS a convicted sex offender. The person was pardoned and is not a registered sex offender. The offense was bad (they all are). The offense
happened 30 years ago prior to the current laws that protect us from
these criminals. Should he be allowed to be a firefighter?


Here are my thoughts. Sex offenders should not be firefighters. I do not know of a National standard or regulation on this issue. However, if this man was pardoned and the infraction occurred prior to current
regulations should he/she still be punished for a crime they was
pardoned for? After all, they were pardoned and basically the crime is
no longer part of their wrap sheet (hopefully there is nothing else).
This is basically a loophole due to previously lackadaisical laws.


I just wonder if fire departments can legally disqualify someone from being a firefighter for something that might not show up on their background check. I am not sure it would in this case, but what if
someone brought it to the FD’s attention.


The questions are:

  • Should sex offenders be allowed to be firefighters? What about EMT’s?
  • Should previously pardoned sex offenders be allowed to be firefighters?
  • What about EMT’s?
  • Does your department look for this information in their background checks?

You might remember a while back that I posted a question on Firefighter Nation about Felons being firefighters. That discussion continues to spark interest from time to time and the conversation is rehashed. My answer remains to be NO. Several people
said that it depended on the crime. My reply….Name a GOOD Felony! I
didn’t think so. Felonies are felonies for a reason. They are crimes.

I don't think that anyone can say anything that would change my mind....I have worked in a correctional facility and that is one crime that even inmates will not tolerate....a child molester...He keeps very quiet and if other inmates find out what he is in prison for they tend to make his life very ugly....
they do it in another career field...but not one of Publis Trust.
Ok so I again agree with you that pedophiles have no business even breathing anymore let alone being a FF.It's the wrongfully accused of rape that their lives are ruined.And some people have went so far as to say people with a criminal record should not be in the service but we are trying to say there are circumstances that are not fair to the individual that did not commit a serious offence
Take it one step further that 17 and 18 year old have been boyfriend/ girlfriend and have been having sex since before the one turned 18. They continue to have sex after and the 18 year old gets charged and convicted of satutory rape. Really hold that against him/ or her? How many of you were in that situation (the age combination)?
Nixon never went to trail. Never convicted, not a very good example. Even though he may have been guilty. He was pardoned before he was charged.
May be charged with public indecency not puiblic urination, depends on the state in which it occurred. As to that seccond chance, they get that job elsewhere and prove to be model citizens and employees, then what? There are so many classes of sex offender, is the streaker the same as the rapist or child molester?

Criminal record, felony record two different things. No felons in the fire service, there are too many non-felons that want the job. They can get their second chances as bakers or shoe salesmen.
I can't agree more, F.F.'s are looked as heroe's by children as well as adults, if we allow convicted sex affender's top join the brotherhood, next they will become EMT"S and MEDIC"S and will be surrounded by children in all situations. The screening process for these positions go to individuals which have clean records. This is a BAD idea.
I wasn't old enough to really remember Nixon as president and have not researched Watergate and history is what the victor s say it is. His guilt or innocence is not the issue here.
No, please do not read into my term of "liberal" I do not mean one party over another...as I feel both parties have their share of crooks..
Just wanted to throw this into the mix. Kind of off topic a little, but still same neighborhood.

What if this guy, or someone like him, wanted to join a department?. He has no sex offense record, no other criminal record. May be a nice enough fellow. Then reveals a book he has written to accentuate his intelligence. He has no record, would he be accepted or rejected? What about his freedoms or rights?
