Maine Firefighter Accused of Making Traffic Stop Over Cigarette Butt

GARDINER, Maine (AP) -- A former volunteer firefighter accused of pulling over a motorist for tossing a cigarette butt out the window has lost his volunteer job as well as his job as a correction officer at the Maine State Prison.

Police say 20-year-old Gerald Michaud III of Gardiner was issued a summons this week for impersonating a public servant, a misdemeanor, and improper use of an emergency light.

Michaud is accused of using the red flashing light on the dashboard of his truck to get the woman to pull over. He allegedly told her he was an off-duty trooper and that he pulled her over for tossing a cigarette and for smoking with small children in the car.

In our state he had every right to pull her over without the red light of course. He can effect a citizens arrest for litering and he has to file the warrant. He just shouldnt have used the light or said he was a trooper. Better yet he could have an officer pull her over and then file the warrant. If he was still a firefighter I wouldnt be suprised if he had a legal right to use the light in some areas where wild fires are common for reckless endangerment. I personaly drive a jeep and had someone throw a cigarette out the sunroof which hit the hood of my jeep. After the second chain smoke did the same I passed them in excess of the speed limit. Of course I met a trooper head on and he pulled me over for speeding. I explained why I was speeding and he left me to go get the guy....for those of you who say just slow down we were going 35 in a 55. The officer said in his book I was justified. He rode a Harley and people throwing cigarettes at him was one of his biggest pet peeves.
I honestly think you guys are missing the point, My opinion is it is more about a 20 year old playing with his lights and being a big boy in control than being upset by the cig..

For a normal cig to start a Wildfire all the right conditions have to be in place and it is harder than one thinks..

Typically, when one looks in the rear view mirror and see's a red or blue flashing lights, it's a cop. It's what they do. Firefighters are NOT cops. We don't pull people over, and we don't pretend to be cops. Not everyone is meant for this job. Not everyone can handle the responsibility and in this case, everyone was done a big favor now that that this individual no longer has any authority to do anything involving the public.
