According to the article, the gentleman in question has a few other charges to answer to as well.

 

However, using the arresting officer's logic; anybody driving through the states of Kentucky and Indiana risk arrest for possession of a smartphone with a media player installed.  As you know, a smartphone equipped in this fashion have the capability to receive fire/police/ems audio feeds from any one of a dozen or more websites.  One doesn't really need an "app" to receive these feeds.

 

These articles are popping up all of the country now as smartphone users discover the hobby that many of us have enjoyed for years!

I purchased a scanner program for my family that was amazing. The phone uses the GPS function to locate the closest radio traffic. A gas station robbery occurred with my wife and daughter sitting in the parking lot... very much out of state as they were driving cross country and listening to the call go down... watching the guy run out of the store, and drive away... With all of that, can you say witness to the crooks leaving and calling 911 with the license plate number?

The scanner transmissions may seem harmless, but in Kentucky and Indiana, it's illegal to use the radios, in any form, in a vehicle.

Capt. Detective Scotty McGaha with the Bullitt County Sheriff's department said burglars often use them to elude police.
"They know where they're at, they know where they're coming from, they know how many units are coming," McGaha said.


"I don't think law enforcement agencies are out there looking for scanners. It just one of the things when the officer makes the traffic stop approaches the car, sees the handheld or an attached scanner of some type that's in the vehicle," McGaha said.


First one should read the facts here. The issue about the scanner (or capabilities) is within a vehicle. Sounds as though this clown had a few other things going on as to why he was stopped. The issue of him having a scanner app/capabilities on his phone is miniscule, just that this is what the media decided to report on. Not being an expert in LE, but in my amateur capacity, I have seen multiple things charged to a person when there is suspicion of something more. Meaning a person being in an accident and suspected of DUI, may also see a seatbelt charge, a using a cell phone while driving, and so forth along with the rest.

Basically, understand the laws, but this probably isn't something to worry about. It doesn't sound as though LE is looking for people with scanners/capabilities, just that it is possible that this could be an issue if stopped for something else. Also, this is the law in KY and IN and the reason being so those who committed a crime aren't tipped off as to where, who, and how many are coming.
