I am currently working on a research project for some governmental classes in college. I want to do something on unfair labor practices vs essential job functions as it pertains to firefighting. I am interested in focusing on disabilities and why they should or should not eliminate a potential candidate for hiring.
That being said I am looking for any links to articles concerning rulings on this or even just interesting stories. Let me know cause again any help would be wonderful.
I recall an article on firehouse.com (I believe) with a FF applicant who had an artificial leg, was able to pass the PAT and met all other requirements for the job and was denied a job due to his artificial leg. I believe the case went to litigation and won the decision and was subsequently hired.
There is a current story developing in upstate NY...There is a blind person that wants to become a Firefighter...He is trying under the American's with Disability act to do so...dosn't make much sense to me but it is becoming a legal issue with the Department.....For further information you might want to contact Mr Dale Gardner at Canton Fire Department in Canton NY....
