If a volunteer retires on disability from his/her job does his/her volunteer company have the right to force them into signing paper stating that they are NOT allowed to do specfic things at a fire scence (ie no hose,ladder scba) or better yet just don't run.
There is nothing in the by-laws or the SOP"s to cover unless it was added after I wrote them for the company. The Person in Question is a life member of the company. and Just the years of experience would be a asset . Years ago there use to be twenty person avg per call now down to ten at the most. The firefighter in question in could be made a driver but the excuse was he lives to far out of town, but one of the chief drinking buddies lives 6 miles farther than the person in question. So this is where the discrimination also come into play, Also the person in question is certified as Safety specialist's in the past has rised questions as to the safety of some of the company practices by=laws and sop's are in place as I said before BUT not followed . The Chief and assist chief have obtained to much power and their words is gospel. or you are treated like dirt to the point you say why respond. hence the low men turn out, but the COMPANY refuses to do anything about it. So this is where the question of a discrimination lawsuit comes into question.
If a person is on workers compensation or has a injury that forces their early retirement you bet your bottom dollar they are to be limited in the firehouse as well. If they are capable of performing everyday firefighting duties with no ill affects they are a fraud, and likely to bring down a lot of bad PR for the department when they get caught. Notice the word I used when, not if?
Besides wouldn't it make sense to not have this person further injure themselves on the fire ground so the department and their former employer are paying compensation? After a disablity it is a doctors note that is required to say the person who was fully disabled has completely recovered and is elgible for full active membership back in the fire department, be it paid or volunteer
