does anyone have any info or like to have info regaurding the soverign immunity issue now making its way through the kentucky supreme court system?

Isn't the issue about respons times and lack of action, etc as opposed to the planning issues?
Yep, that was sort of how it read to start, then I got thinking that if the Caneyville VFD did not know that a business was operating from those premises, and were not advised on arrival of the nature of the business then how can they be held to account?

I guess from my perspective it comes back to how can you plan to act or respond in a certain way if you don't know what risks you are trying to manage for. Same goes for planning for mutual aid.

Not sure about the response time issue?

I'd read about this elsewhere, so just went looking. Here's an excerpt from The Lexington Herald-Leader, Ky. .
On the ice-cold morning of Dec. 3, 2003, a shed at the back of the business's property caught fire, possibly because of an electrical short, Cathy Green said.

The Caneyville Volunteer Fire Department was called, and it arrived with a small firetruck.

It soon became apparent, Green said, that the volunteers were not equipped to handle the fire. He begged them to call the professional, paid fire department to the east in Leitchfield.

"We were begging for more help the whole time and they wouldn't do nothing about it," Green said.

Cathy Green says the volunteers underestimated the fire.

By the time volunteers changed their mind, it was too late. The fire had consumed another building which housed all of Green's inventory, equipment and tools.

Green's buildings were insured. The motorcycles and parts were not.

"We weren't planning on anything like this," Green said.


I just love the last line!
I love the last line too, like ANYONE ever PLANS a fire. Well you know what I mean.
I get a kick out of reading media reports of fires or other incidents. They report what they see going on which isn't always the whole picture. Of course the Greens are upset, anyone would be but how do they KNOW the department wasn't calling for more help? I have dealt with property owners who's sees their life going up in flames. We've had reactions from people meeting us @ the door with shot guns to people crying & begging us to hurry, to people who don't want you to fight the fire. They would rather start all over than to have half a house then when you make a good save they are happy about it.
