I have 19 years of service as a firerighter/engineer from Ky. Also member of Local 870.
I was injured while fighting a fire in Feb/2015! I've had. Shoulder reduction and two shoulder surgerys! Oh, at the time of injury I was 59. In a nutshell I've been fighting with the city and WC to go back to work! I successfully completed a firefighter physical agility test done of my firefighter job discription. This test was ordered from my Surgeon and physical therapist. It was done at our departments training center. However the city and WC did not approve this testing! My surgeon signed a release to return to work with no restrictions.
The city and WC ordered me to complete another evaluation (3 1/2 hours). I passed this test as well. Both of these test were done in Feb/2016.
I've been asking since Feb to return to work. I couldn't get a answer! I even hire. WC attorney in Feb. still
No results! Then, the last week of March the City and WC put me on straight WC pay(66 2/3). If that's not bad enough they took away my service accrual time, vacation time, and sick Time!
Our local is not recognized. But I contacted our local requesting a face to face with a Union attorney. I had my meeting and after two phone calls, one to my city attorney and one to WC attorney, in less than 24 hours I got phone calls saying I've been cleared to return to work! I'm back to work. I still have some health issues, but they didn't stop me from passing two physical agility test!
Where I need some help is that I need to find an attorney to help me get the benefits taken from me. My Union attorney said that based on what I've told him that I have a Age Discrimination situation. To me, it's not about the money. It's about principles. No one deserves to be treated like I've been treated. I don't want another firefighter to go through this. I'm looking for an attorney who will fight for me!
