Folks...I am attempting to back a position which would require a disciplinary action to be removed from an employee's file following a given time frame of good behavior.  Can anyone help support this or am I crazy?

That would depend on what your department's policies & procedures manual spells out. It would most likely entail a change in the P & P manual that would have to be approved by the department's senior officers.

We have a formal procedure where low level offenses are stricken if there is no further disciplinary problem within one year.

Is your department a union department? If so there may be some options there. If not they may be able to get something in place for in the future.

When you say you are "attempting to back", what does this mean? Is this a proposal you, yourself are looking to implement, or is this something someone else is bringing forth and you agree with it? Does this mean there is resistance to implementing such a policy by others in a management position?

To me, I don't see why there would be any issue in having some type of language either in the contract or as part of a Constitution and By Law change, or change to dept policy and procedure.

 

Who would make such a decision? If you are in a mgmt position, then why couldn't you just get something like this pushed through?

 

If looking for other support, you would have mine. It would depend upon the severity of the offense, but minor issues don't need to be part of a permanent record. Some issues out there may remain part of a permenent record, but would only have "teeth" for a period of time. Similar to a military eval, say one had a non-judicial punishment (NJP), the NJP would affect the person's evals and promotional opportunity for the next cycle etc. Yet, years down the road, the NJP would still be part of the record, but doesn't affect promotion, Good Conduct medal parameters, etc.

Are you hoping to have a fundamental rules change made in your department's policies and procedures or by-laws?

Or is your effort simply in regards to an individual case?
